I believe there is a NY Court of Appeals decision that says conviction occurs when the jury returns a guilty verdict. So, Trump is already a convicted felon under NY law, even if he escapes sentencing.

JennSH from NC's avatar

It would seem to that when a jury reaches a verdict, a person is convicted. Sentencing is the determination of what punishment a person receives.

As for the corrupt high court, they MADE UP immunity out of whole cloth. It’s bullsh*t. These six are bought and paid for political hacks. I have no respect for this court as currently constituted.

I believe they are about to test and see how much lower public opinion can go..........

This should be the reason don-old should show up on Friday.

If that were true, he could not have voted in the last election on Florida.

Or even be on ballots?

Apparently, the fact that he was not incarcerated makes a difference.

Yes. Because fucking Florida

Sadly, no.....it will all be erased once Trump is the actual President. That's why the pressure.

Absolutely correct. NY CPL 1.20(13) states: "Conviction" means the entry of a plea of guilty to, or a verdict of guilty upon, an accusatory instrument other than a felony complaint, or to one or more counts of such instrument.

I certainly don't trust the supreme court

I'm hoping Biden uses the supreme court decision of immunity to release the DOJ reports on both cases. The entire world needs to know what a traitor Trump is. If course he doesn't want it to be public. The supreme court will be behind Trump All the way. Merrick Garland is too afraid. Jack Smith doesn't have immunity so Biden is our only chance because it's going to be his last official act unless he has him arrested on the 19th.

But especially the classified documents case because there was no question his actions are traitorous. I grew up in Oak Ridge and security was ingrained in us. Classified documents being bartered with foreign powers is particularly heinous. Nobody has ever been so blatantly unamerican.

Open and shut and Cannon should be disbarred by the ABA since she's appointed for life. She'll end up on the supreme court for her loyalty to Trump rather than the Constitution. She's as traitorous as Trump as are many of his cabinet & staff, Congress and the billionaire oligarchy.

I've got no faith in Merrick Garland. He's been the biggest AG failure in the history of the country since it's looking like there's going to be nothing left of the Constitution. His lack of fortitude is 100% the reason Trump is going back to finish the job. One man could have saved us from ourselves.

Totally agree, Just. In Navalny’s recently released Memoir, much of which was written in prison before Putin’s final poisoning of him he said of Russia’s judicial system, “They simply invent charges and appoint victims as they go along. It is usually difficult to explain this to those living in countries that respect the rule of law.” It seems to me that is exactly the direction our legal system is heading at an alarming pace thanks to McConnell, Trump and the judges they have appointed to gut the US rule of law!

By dragging his feet in a dubiously claimed attempt to avoid appearing partisan, Merrick Garland totally f*cked up the multitude of cases that were brought to trial far too late to hold a meritorious trial with swift sentencing; not to mention those that haven't even been brought to trial yet. None of his actions or inactions probably rise to the level of chargeable offenses but they should. He should not emerge unscathed from the shame and criminality of his decisions to slow walk justice to the point that justice is never served.

I like your post, but that "one man" is Mitch McConnell, not Garland.

The most odious court and the most odious president elect ever….

DJT Luvsputin's avatar

Trumps stigma was created by his own corruption and he was unanimously found guilty on all counts. Play, get caught, Pay.

David J. Sharp's avatar

Seriously, I am simply astonished at the amicus brief—where points & authorities are necessary, the brief only offers points of bombast and ego. The former president’s recent election was not mandated but barely eked … and this is just one instance.

David J. Sharp's avatar

Excellent analysis notwithstanding, what the Court should do and what it WILL do, is confounding. The Roberts Court - or 2/3s of it - seems to give unwarranted emphasis to the vagaries of Trump. Judge Cannon’s only question is, “How high?” SCOTUS actually writes down on paper absolute drivel about immunity, accepts and compounds his delay tactics. I am not optimistic here.

Joan's avatar

Cannon ought to be impeached, she’s either malicious or incompetent ….

DJT Luvsputin's avatar

The soulless Cannon is extremely biased and vying for a promotion to supreme court justice.

David J. Sharp's avatar

Impeached by a groveling House? We will have a snowball fight in hell first.

May May's avatar

And I thought Cannon DISMISSED the stolen classified documents case, so she's done. How is SHE allowed to pass any ruling on any aspect of that case at this point??

David J. Sharp's avatar

Just shows the sorry state of law these days. Apparently Cannon considers herself the voice of the new (Trumpish) order of things—when your lord beckons you bow thrice and obey.

This is all so out of what trusting our courts and our laws makes us so concerned. Not a single citizen or non- citizen in this country would ever have the same level of treatment as this would-be dictator. Equality and respect do not even come close. The ramifications of fairness do not even live in the same circle. DEMOCRACY ?? Where?

Francine Koski's avatar

Considering how corrupt this Supreme Court is, they, especially certain judges, need to be investigated and prosecuted for bribery and fraud and not standing up for the values they were chosen for, which is the demand for impartiality. They have lost 😡 the confidence of their own constituents, the American people 🇺🇸.

James Burnham's avatar

If Coney Barret decides against the stay, we still need one more of the five remaining corrupt justices to go against Trump. Who will it be? I'm not hopeful.

I read today that the sentencing in NY for WEIRDO TRUMPTY DUMPTY for his 34 convictions, was blocked by SCOTUS!! Not positive about this yet. But that means WEIRDO isn't going to be held accountable for any of his MANY crimes!!!!

Cindy Burkhalter's avatar

Thank you so much for your clear explanation. This lay person greatly appreciates it!!👍🏼

This SCOTUS has been bought and paid for by tRump. That's why everything these days gets kicked up to them to decide! So, OF COURSE they will let their boy Don off the hook. I'd be floored if it went any other way. You can be sure he's giving them an earful right now - - "don't screw this up for me, or else!!"
