I was shocked & disgusted as I looked into how James Comey was forced out of his position by, "Your Oath is to Me; What's a Constitution" DJT. At that infamous "private" dinner.

And as soon as I saw that Wray was "pre-emptively" stepping down, stepping aside, DESERTING HIS OWN AGENCY & those of us who are sane, sober Americans, my heart sank.

I think Christopher Wray's move to step down was a smart one. This blocks trump from appointing a Acting position, where there's No Oversight or approval by Congress. He will Have to appoint someone to fill Wray's seat and go through the proper channels Now ! Thank You, Harry, for your insight on this topic today, and will reStack ASAP 💯👍

I know that view is out there, but I think it's mistaken. Wray's resignation doesn't constrain Trump's options in any way, on either the nomination or the bypass plan. Sticking around would have until Patel was Deputy or a similar position for 90 days.

We know Wray is a registered Republican and perhaps even voted for Trump. It feels like we have fewer mainstream avenues to get realtime info to ALL the voters and if Wray had resisted, the result would have been loud and messy. More and more ppl would have become aware of some version of the norms, govt oversight & over-reaching of the cheeto. Maybe Wray doesn't want that to happen?

If I may be so bold - I am of the belief that Trump doesn't really care who he nominates, bootlickers, yes, but remember how he loves "acting" heads of departments? Over half his administration had empty desks because he never appointed anyone. And then no one could tell him what to do. I am not surprised at all the wildly hair-brained nominations he's making. Doesn't matter if Wray resigned or not, IMHO. Doncha think?

I think Wray is correct to let the sand find its own way into the gears--or not, as the Senate sees fit. I don't see much benefit to Wray or his agency to do otherwise in the current environment. Leave it to the Senate to decide whether to exercise or abnegate its power of oversight over Cabinet appointees.

I know this may be beating a dead horse, but.....Biden needs to report on Russian interference ASAP! We are the victims of the Russian war on the USA. There's a whole lot of questions that we Americans deserve to have answered, such as:

1. Why did Trump tell his supporters that he didn't need their votes at one of his hate rallies BEFORE the election?

2. What EXACTLY was Trump and Moses Mike's "little secret" that was going to somehow win them the House?

3. What EXACTLY was the real reason for Musk's online "voter registration" operation in Nevada, and his almost certainly illegal "1st and 2nd amendment pledge" operation in PA? Furthermore, why did Garland refuse to launch an investigation into them?

4. What EXACTLY was the real goal of the dozens of bomb threats that Russia is accused of sending in to polling centers in almost all the swing states, predominantly in blue leaning areas? Why is the federal govt doing NOTHING to respond and hold them accountable? Were the bomb threats meant to distract attention away from certain areas for a specific reason?

5. Why was Musk in regular communication with Putin in the last few months leading up to the election? Why did Garland not consider investigating him for violating the Logan Act, among other likely crimes?

6. Why in the holy phuck was Musk on the phone call that Trump made to Zelenski after he "won" the election? Why is that NOT being looked into, especially considering that Musk (and possibly even Trump) doesn't have any of the security clearances to be on those types of calls? What the hell did they talk about?

7. How in the ever burning hell did Trump "win" ALL 7 swing states? I mean, come the phuck on now 🤨

8. Why did multiple "red" states, like mine here in Flori-duh, refuse to allow DOJ election monitors into any of their polling centers as voting was underway? And yet again, why did Garland do NOTHING about it?

9. Why are NONE of the MSM "news" networks loudly pointing out the fact that as soon as Trump "won", he and the entire GOP just magically quit pretending that any "massive election fraud" took place?

10. What EXACTLY did Putin do to help Trump win the election? We know he obviously helped in some significant way considering that Putin has been openly bragging about doing so, and Trump has done nothing to even attempt to refute or deny the claims.

11. Finally, how the hell are we ever gonna deprogram the 70+ million hopelessly gullible fools who STILL believe Trump to be some infallible god, and who believe every lie the conservative propaganda machine feeds them?

I agree with everything you have said...And as a small correction, DJT actually said he didn't need votes in MULTIPLE rallies and/or appearances he had...At least 5 or 6 of them...And that ALONE made me HUGELY suspicious aside from all your other accurate points....I just don't understand how all of this is overlooked and not acted upon in some manner...I thought at first, the government was working on these things 'under the covers' until they had enough proof...But now, it is getting so close to the inauguration, I fear nothing may happen to stop this corruption!!!

You're probably right but Biden has only 38 days to act, and has to zone in on the ongoing national security/ election issue. IMHO there is alfeady enough to assert emergency powers. Russia is an easy target. Putin admits, brags about it.

Not just the election, war powers. When Roberts worked for Reagan, he worked out a scenario where Reagan would declare himself a "unitary executive," suspend Congress and the courts. That should be enough to make Trum start negotiating.

He still has huge civil liability stemming from the Jan 6 case..... Many of his appointees remain potential subjects inder state law.

Appreciate your writing Harry. Another person shared this - what is your reaction to it, is it possible? “By stepping down now, as the conservative writer Erick Erickson observed, Wray has created a “legal obstacle to Trump trying to bypass the Senate confirmation process.”

Here’s why. According to the Vacancies Reform Act, if a vacancy occurs in a Senate-confirmed position, the president can temporarily replace that appointee (such as the F.B.I. director) only with a person who has already received Senate confirmation or with a person who’s served in a senior capacity in the agency (at the GS-15 pay scale) for at least 90 days in the year before the resignation.

Kash Patel, Donald Trump’s chosen successor at the F.B.I., meets neither of these criteria. He’s not in a Senate-confirmed position, and he’s not been a senior federal employee in the Department of Justice in the last year. That means he can’t walk into the job on Day 1. Trump will have to select someone else to lead the F.B.I. immediately, or the position will default to the “first assistant to the office.”

In this case, that means the position would default to Paul Abbate, who has been the deputy director of the F.B.I. since 2021, unless Trump chooses someone else, and that “someone else” cannot be Patel, at least not right away.

The bottom line is that the Senate has to do its job. Wray is foreclosing a presidential appointment under the Vacancies Reform Act, and — as I wrote in a column last month — the Supreme Court has most likely foreclosed the use of a recess appointment to bypass the Senate.

But if Trump appointed Patel to another senior position in the agency (that does not require Senate confirmation), then an Acting Director could serve for the 90 days it would take for Patel to bypass the need for a Senate confirmation and be put into place as Director without Senate confirmation once Trump forced out the then Acting Director without Senate confirmation Patel as permanent Director.

Still, I don’t think Wray, or anyone else, should just acquiesce and step aside so easily.

This was never a decision to save the FBI from scrutiny or protecting the institution from harm. Wray is a lifelong republican. He earned his stripes as a yes man, and I guarantee you, as much as Wray despises Trump, the decision was one of self preservation.

This Trump administration is hell bent on revenge and retribution; whether real or perceived! They are petty and vindictive, and now control the greatest of possessions; unchecked power. He controls all levers of power, and even has a fascist SCOTUS waiting in the wings to help him dismantle the administrative state piece by piece; although they’ve been doing a bang up job so far.

Furthermore, this is Wray just being pragmatic, and was most likely offered a seven figure salary at a white glove law firm, or conservative corporation to step aside, and save himself, and the Mango Moron Elect, any further humiliation or problems fulfilling Trump’s future agenda.

Let’s face it, all the pillars of our democracy are falling in line. And it’s about to get very scary. Just a small series of changes could have serious consequences to our future republic and well being.

In Harry Litman’s inaugural blog explaining his resignation from the LA Times, I commented that as a subscriber I was hesitant to cancel my subscription in protest because it would only be felt by the beleaguered journalist/employees and not by the despicable owner who makes self-censorship and subservience to Trump a way of life. I would wait for the next shoe to drop. Well, another shoe has dropped: The owner just forced cancellation of an editorial critical of Trump’s egregious cabinet picks. I still feel for the employees and will wait a bit longer, but I think the die is cast: The owner is trying to force the employees to resign so he doesn’t have to pay severance. A very sad state of affairs. The owner should sell the LA Times and retreat to his cash register.
