The US and El Salvador have an extradition treaty and SCOTUS could have issued a writ of mandamus to Trump/Rubio to extradite him -- but didn't. 9-0! What about the 3 Dems?

I don't know whether the judge was asked to enter an order of mandamus. At SCOTUS, could have been done sua sponte, own motion, by one of the Dems.

A writ of mandamus is a court order compelling a lower court, government official, or agency to perform a specific act that they are legally obligated to do. It's used when there's no other adequate legal remedy to force compliance with a clear legal duty. In essence, it's a way to ensure that those in authority follow the law and fulfill their official duties.

Regardless of whether our courts (or more specifically, some judges) are corrupt — which is a separate discussion — the courts in this case have followed the law. It is the corrupt Trump Administration that is flouting the courts’ rulings.

Inpeachment and removal is the only recourse. The Constitution states the entire Administration shall be impeached and removed for treason, bribery, and other high crimes and misdemeanors (Article 2, Section 4).

Perhaps an immediate contempt of court ruling with the govt attorney taken directly from the courtroom to a jail cell until that lawyer agreed to conform to the ethical rules of attorneys & officers of the court and answer the judge’s questions directly and honestly. One lawyer after another incarcerated until we essentially have another version of a “Saturday night Massacre” where all litigation attorneys resign rather be sent to jail for disobeying and disrespecting the court’s authority.

Remember, such a jailing leaves the key to the jail cell in the lawyers’ hands. All they need do is follow the law to be released.

Disbarment normally is done by a private Board of Bar Overseers, not the government. Since Trump has now gone after the American Bar Association, the various state (and federal) Boards may have a bit more incentive (and backbone) to take action against corrupt-acting attorneys. It’s not a quick process though (see, e.g., the disbarment of Giuliani)

UPDATE: Trump just met with Bukele and reiterated that he had no power to return Kilmar Abrego Garcia to the United States. Bukele said he had no intention of returning Abrego Garcia.

And then Trump claimed that the Supreme Court had ruled 9–0 in his favor on the case and that the Court’s decision meant only that the U.S. government would have to provide a plane if Bukele chose to return Abrego Garcia.

So Trump not only refuses to comply with the Roberts ruling, but he has now completely mischaracterized it.

What will the Supreme Court do in response?

IF he is indeed a gang member (of any gang), the government simply has to prove that in a court of law and deport him. At that point, I don’t know whether the earlier court ruling that he can’t be deported back to El Salvador would stand, but the government could deport him elsewhere, regardless.

But first, the Constitution requires basic Due Process that the Trump administration just ignored and continues to ignore.

I’m not as knowledgeable about this as you, but my understanding is that PRUCOL is a temporary status allowing access to certain benefits (e.g., Medicaid) but once that person receives a green card to work legally — which I believe Garcia has — that person is no longer under PRUCOL.

So many questions. How much is the US paying for the prison in El Salvador to incarcerate those 200+ prisoners? How many of those in the government are profiting from investments in private prisons like this? What happened to the law about making a profit on items while you are a President, such as his hats (made in CHINA); his golf club covers (made in CHINA) and so much more. Who is watching the spending and the profiteering of this? We now have a shadow government and no one seems to know much about where the "saved" money is going or gone to, as well as so much profiting on every bit of merchandising. Well, there is so much more but the American people need more information on all of this and if it is legal.

As part of a $1.4 billion loan agreed with the International Monetary Fund in December, the government’s involvement with the digital Chivo wallet will be “gradually unwound.” At the end of January, on a vote of 55-2, El Salvador’s Legislative Assembly passed modifications to the Bitcoin law, eliminating the word “currency” but keeping it legal tender. The changes will take effect May 1, 90 days after the legislation appeared in the official newspaper.

“Bitcoin no longer has the strength of legal tender,” economist Rafael Lemus told AFP. “It should have always been that way, but the government tried to force it into existence, and it didn’t work.”

Users are now free to accept Bitcoin or not, but it cannot be used to pay taxes or state bills. President Nayib Bukele admitted that introducing Bitcoin as an official currency alongside the US dollar in September 2021—the world’s first such move—had been his government’s “most unpopular” measure, alongside stringent anti-gang security measures.

El Salvador still has 688 Bitcoin in reserve, worth an estimated $574 million, of which $287 million is profit.

On February 13, Bukele and Microstrategy Executive Chairman Michael Saylor discussed how Bitcoin adoption could be accelerated worldwide, with El Salvador’s National Bitcoin Office considering establishing nodes in each household. The aim was to boost public perception of how Bitcoin can work in daily settings.

“President Bukele continues to buy Bitcoin, we have a Bitcoin Office, we have the Bitcoin Law, Bitcoin can be used in El Salvador,” El Salvador’s ambassador to the US, Milena Mayorga, assured at a Bitcoin conference.” But, “it has not been an easy road.” A survey published by the Jesuit Central American University in January revealed 92% of Salvadorans had not used Bitcoin in 2024. Of the 8% who said they had done so, the average was only 14 times a year. Family remittances via digital wallets amounted to $7.22 million in December 2024, less than 1% of the total sent.
