Harry - please start with Halligan's undeniable qualifications: she's pretty, does amazing work on FOX, and she's young. Let's not discount those factors when considering the traditional qualifications for a job as important as the Eastern District. You know, a decade as a prosecutor, numerous high profile cases in the bank, credibility. Old school.

This is the first I've heard that the FVRA may come into play. It seems clear that Halligan can't meet the 90-day-inhouse requirement.

That should blow her appointment right out of the water -- and the case too, since she couldn't find anyone else willing to sign the paperwork.

One of my friends noted another potential flaw. Apparently Halligan, the signing attorney on the filing, hasn’t been admitted to the Virginia bar. So even without the lack of actual probable cause, they haven't followed the basic requirements for filing.

I've wondered about that. Apparently the norm is that if a US attorney is qualified otherwise and properly appointed, s/he is considered "inherently" a member of the Circuit Court bar,

But there is that really big IF, here.

As a former attorney and administrative law judge, I find it hard to believe that such high placed attorneys in this administration are so inept. How did they survive in private practice? Maybe they had competent support staff and supervising attorneys. Unfortunately, they left them back in their offices so we all have to suffer through their bumbling. JA

If I were Comey's lawyer I would be torn between wanting to file a pretrial motion to cut this case off at the knees, and waiting until a jury is sworn in so that double jeopardy attaches. If you fail to raise certain issues via pre trial motion, however, you waive them. Difficult decision. But if the statute of limitations on his testimony has run go for the pre trial motions!

What are the prospects that any DOJ lawyer carrying out such vindictive prosecution will lose their law license? The legal profession should stand up right now and issue a warning and make it clear they will stand by it.

I hope this isn’t too technical- but how do we find out what actually happened in the Grand Jury if those proceedings occur in secret? But, you mentioned a transcript Harry and I am really curious if Halligan herself actually appeared before the Grand Jury with all her insurance defense experience and nothing else. Surely, there were irregularities-will we, the American public, ever find out how she managed to get an indictment on two counts with such a dearth of evidence?

Query: I assume that conversations about the case between Trump, Bondi, and the newly named prosecutor are generally privileged. But has Trump opened the door with respect to such inquiries by posting his directive on social media?

Is there any indication that Lindsay Halligan is even admitted admitted to practice in the EDNY or, for that matter, sought admission pro had vice.
